These Terms and Conditions ("Terms") govern your use of the Tuga Hardware website (tugahardware.com) and any purchases made through it. By placing an order, you agree to be bound by these Terms. Please read them carefully before purchasing.

1. About Us

Tuga Hardware ("we", "us", "our") is a trading name of Destello Tech Ltd, a company registered in England and Wales with company number 16595781, whose registered office is at 124 Vicarage Wood, Harlow, Essex CM20 3HH. We sell rugged tablets, handhelds and related accessories. You can contact us at support@tugahardware.com.

2. Products

All products listed on our website are subject to availability. We make every effort to ensure product descriptions, specifications, and images are accurate. However, minor variations may occur between what is shown on the website and the product delivered. If a product does not match its description in any material way, you are entitled to a full refund under our returns policy.

3. Pricing

All prices on our website are displayed in British Pounds (GBP). Destello Tech Ltd is not registered for VAT, so no VAT is charged and the price shown is the total you pay. We reserve the right to change prices at any time, but changes will not affect orders that have already been confirmed. In the unlikely event that a product is listed at an incorrect price due to a technical error, we will notify you before processing the order and give you the option to proceed at the correct price or cancel.

4. Placing an Order

When you place an order through our website, you are making an offer to purchase the products in your cart. We will send you an order confirmation email acknowledging receipt. A binding contract is formed only when we dispatch the products and send you a shipping confirmation. We reserve the right to refuse or cancel any order for any reason, including suspected fraud or product unavailability.

5. Payment

We accept credit and debit cards, plus Apple Pay, Google Pay and Klarna where they are offered at checkout (all processed by Stripe), and PayPal. Payment is taken at the time of order. All transactions are processed securely through our third party payment providers. We do not store your full payment card details.

5a. Warranty and paid plans

Standard warranty. Every Tuga device carries a 12-month warranty from the dispatch date on your invoice against defects in materials and workmanship. If a covered defect appears in that period we repair the device, or replace it with the same or an equivalent Tuga model, at our choice and at no charge; if we can do neither, we refund you. The battery is covered against defects; normal capacity loss is not a defect. We reply to a warranty request within one working day, and within two working days of receiving the device we tell you what we will do and when. We aim to dispatch the repaired or replacement device within ten working days of receipt.

Carriage. Business buyers pay the carriage to send a device to us and we pay the return carriage after a valid repair or replacement. If you buy as a consumer and the device is faulty, we pay the postage both ways under the Consumer Rights Act 2015.

What is not covered. Accidental damage, liquid damage, fire, loss and theft; cosmetic wear that does not affect function; normal battery capacity loss; consumables such as screen protectors, straps, styluses, seals and cases; software, apps, operating system updates, data and settings; misuse, modification, use outside the published ratings, third-party chargers, or repair or opening by anyone we have not authorised; devices with a removed, altered or unreadable serial number; and devices outside the United Kingdom. The standard warranty and the 3-Year Warranty do not cover accidental damage, theft or loss; Total Care does, within the limits in the Plan Terms. We do not insure devices.

Paid plans. The Tuga 3-Year Warranty and Tuga Total Care are governed by our Plan Terms, which also set out this standard warranty in clauses 44 to 49 in the same words as this section. The 3-Year Warranty extends this standard warranty to 36 months on the same terms and is available on every Tuga model, at checkout or on a quote. Total Care adds advance replacement and cover for accidental damage, theft and loss, and is available on every Tuga model, on a quote, to business customers (sole traders included) with five or more Total Care devices. A plan bought with a device is refunded in full if the device is returned or cancelled under section 8, and moves to the replacement device if a device is replaced under warranty.

Your rights. Nothing in this section reduces a consumer's statutory rights under the Consumer Rights Act 2015 or the Consumer Contracts Regulations 2013; where they are more generous, they apply.

6. Delivery

We offer free standard delivery to all UK addresses. Estimated delivery time is 7 to 10 working days from order. We deliver to UK addresses only and do not accept orders for delivery outside the United Kingdom. Delivery times are estimates and not guaranteed. If you bought as a consumer and we have not delivered within 30 days of your order, or by any later date we agreed with you, you may cancel the order for a full refund. We are not liable for delays caused by carriers or events beyond our reasonable control.

7. Risk and Ownership

Risk of loss or damage to the products passes to you upon delivery. Ownership of the products transfers to you once we have received full payment.

8. Returns and Refunds

You have the right to return products within 30 days of delivery for a full refund, provided the items are in their original condition and packaging. To initiate a return, contact us at support@tugahardware.com with your order number. Full details of our returns process are available on our Shipping & Returns page.

Under the Consumer Contracts Regulations 2013, you also have a statutory right to cancel your order within 14 days of receiving the goods, for any reason. This is in addition to our 30 day returns policy.

9. Warranties

Our standard warranty and paid plans are set out in section 5a above and in our Plan Terms.

10. Limitation of Liability

To the maximum extent permitted by law, Tuga Hardware shall not be liable for any indirect, incidental, special, or consequential damages arising from the use of our products or website. Our total liability for any claim related to a product shall not exceed the purchase price of that product.

Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded or limited under applicable law.

11. Intellectual Property

All content on this website, including text, images, logos, and design, is the property of Tuga Hardware or its licensors and is protected by UK and international copyright laws. You may not reproduce, distribute, or use any content from this website without our prior written consent.

12. Use of the Website

You agree to use this website for lawful purposes only. You must not use this website in any way that could damage, disable, or impair its availability, or interfere with any other party's use of the website. Automated crawling is welcome within the limits set by our robots.txt file; bulk copying of our content for republication is not.

13. Third Party Links

Our website may contain links to external websites. We are not responsible for the content, privacy practices, or availability of any third party sites. Linking to an external site does not imply endorsement.

14. Force Majeure

We shall not be liable for any failure or delay in performing our obligations where such failure or delay results from circumstances beyond our reasonable control, including but not limited to natural disasters, pandemics, strikes, government actions, and supply chain disruptions. This does not affect your right to cancel for late delivery under section 6.

15. Privacy

Your use of this website is also governed by our Privacy Policy, which explains how we collect, use, and protect your personal data.

16. Changes to These Terms

We reserve the right to update these Terms at any time. Any changes will be posted on this page with an updated revision date. Continued use of the website after changes are posted constitutes acceptance of the revised Terms.

17. Governing Law

These Terms are governed by and construed in accordance with the laws of England and Wales. Any disputes arising from these Terms or your use of our website shall be subject to the exclusive jurisdiction of the courts of England and Wales.
